Case 1:
The team advised a public body in respect of financial irregularities arising out of a £5m+ contractual relationship with a third party. The team provided forensic and financial investigation services to determine the extent of financial improprieties and loss to the public body. We were instructed to investigate an alleged fraudulent scheme and advise on the prospects of asset repatriation and recovery.
Case 2:
The team advised in proceedings brought by company against over 150 defendants for losses suffered as a result of an alleged fraud perpetrated by a network of individuals.
The company alleged that a number of key individuals perpetrated this fraud using an employee of the company to value properties at an inflated price. These properties were purchased by people whose identity had been stolen and subsequently their accounts would go into arrears. The lender proceeded to litigate against the company for the provision of the negligent/fraudulent valuations. The company undertook a detailed investigation into the operation of the key defendants and issued proceedings for recovery of the losses they had suffered. The proceedings included injunctive applications for disclosure, delivery up and freezing orders.
Case 3:
The team advised a company in proceedings for alleged breach of warranties arising out of a Share Sale Agreement for a company in excess of £1m. The claim was for damages arising from fraudulent breach of warranties which resulted in over valuation of shares in the acquired company. We were initially assisted by obtaining a freezing injunction on specific assets of the defendants to the value of £0.5m for the long-term protection in the litigation. This was an extremely document-intensive case involving analysis of thousands of pages of information in order to unravel the fraud.
Case 4:
The team advised an individual in bringing a claim against multiple defendants, both corporate and individual, regarding the transfer of a commercial property portfolio in excess of £1m in value. The individual alleged that the defendants had exerted undue influence to engineer the transfer of the properties from them. The case embraced the need to master multiple angles of investigation of business intelligence to establish issues of alleged deceit and irregular company transactions so to construct the supporting evidence to the individual's claim.
Case 5:
The team advised an individual who was the victim of a fraudulent transfer of their property. This involved claims for professional negligence against the solicitor who purportedly acted in the transactions, the lender and the perpetrator of the fraud. The investigation centred on the reconstruction of the transactions by the perpetrator who had enacted the fraud. Upon our detailed forensic analysis of the documentation, including use of a graphologist, our team were able to unravel the fraud for the benefit of the individual.
